The Terms and Conditions outlined below are designed to act as clarification should a dispute arise during my work for you. In hiring me to complete copy for you I will request that you read and acknowledge these Terms and Conditions by submitting your name and email address at the bottom of the page.
Throughout the Terms and Conditions, ‘You’ means yourself, the individual agreeing to the Terms, and any company or organisation on behalf of which you act. ‘Me’ and ‘I’ refers to myself, Ellie Scott.
1. What the Terms and Conditions represent
Upon hiring me, you agree that you have read, understood and are bound by these Terms and Conditions at the time of hiring. You agree that these Terms and Conditions, displayed at www.elliescott.co.uk/terms-and-conditions take precedent over all other terms.
Should you be working on behalf of another company, for example as a marketing or web development agency, you agree that this contract exists between me and you, and not between me and the client for which you are working. You therefore agree to indemnify me against any claim by your client for compensation or damages brought about as a result of my work.
2. The work undertaken for an agreed fee
Fees are agreed in Great British Pounds (GBP, £).
Once a fee has been agreed upon in writing (i.e. via email) it will not change. Edits to copy will be completed at no extra cost, within reasonable limits, to ensure you are content with the work.
As a guideline, the writing services I provide are defined as: completion of first draft; submission of first draft; integration of your feedback and completion of second draft; submission of second draft.
3. Payment terms
Payment should be made in GBP (£). Although I may provide you with a rough estimate of the final fee in your local currency, you must complete payment in GBP.
I reserve the right to request a deposit, at my discretion, in advance of work commencing after a fee has been agreed upon in writing.
Invoices are submitted after the second, final submission of copy. Full payment is to be made within 30 days of receipt of the invoice; the final due date is displayed on the invoice. Payment can be made via bank transfer or PayPal, the details of which are included in the invoice.
Should your accounts department require further payment details in addition to those provided on the invoice, they must request this information from me in sufficient time to complete payment within the 30 days of receipt of invoice.
The existence of an ‘end of following month’ practice of payments in your company does not alter your obligation to make payment before or on the due date displayed on my invoice.
Should you fail to make payment within 5 days of the due date shown on the invoice I reserve the right to charge statutory interest of 8% plus the Bank of England base rate for business to business transactions, which is currently 0.5%. Failure to pay would therefore subject you to statutory interest of 8.5%.
4. Delivery dates
The delivery date for all work (final submissions) is agreed in writing via email prior to work commencing.
Upon hiring me to write for you, you are purchasing the copyright for the work I produce. Only once full payment has been made does copyright of the work in question pass from me to you.
I reserve the right to use a small extracts of the completed work for promotional purposes, and may display them on my portfolio website, www.elliescott.co.uk.
